Appellant Laurel Belnap, widow of Woodruff Belnap, seeks widow's pension benefits under the Industrial Insurance Act following the death of her husband as the result of an automobile accident on October 24, 1985. In February 1986, the Department of Labor and Industries rejected the claim, finding that Mr. Belnap was not in the course of his employment with The Boeing Company at the time of the fatal accident. Mrs. Belnap appealed the Department's order to the Board of Industrial Insurance Appeals. In January 1987, the board issued a proposed decision and order sustaining the order of the Department. Following this, Mrs. Belnap appealed to the King County Superior Court. On February 7, 1990, the Superior Court affirmed the denial of widow's pension benefits, finding that the decedent was not acting in the course of his employment with The Boeing Company at the time of his fatal accident.
